Terms of Service
Last updated: March 25, 2025
1. Introduction
Welcome to SupaWave, a real-time collaborative messaging platform operated by WavelyLabs ("we," "us," or "our"). SupaWave enables users to create, share, and collaborate on rich conversations called "waves" with live editing, threaded replies, and multimedia attachments.
These Terms of Service ("Terms") govern your access to and use of the SupaWave platform, including all associated services, features, and content.
2. Acceptance of Terms
By creating an account, accessing, or using SupaWave, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the platform. We may update these Terms from time to time, and your continued use of SupaWave after such changes constitutes acceptance of the revised Terms.
3. Account Registration
To use SupaWave, you must create an account by providing:
- Username — a unique identifier consisting of letters, numbers, and periods
- Email address — used for account verification, password resets, and important notifications
- Password — stored securely as a salted hash; never stored in plain text
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access.
4. Acceptable Use
You agree not to use SupaWave to:
- Send spam, unsolicited messages, or automated bulk communications
- Harass, bully, threaten, or intimidate other users
- Post, share, or distribute illegal content or content that violates any applicable laws
- Impersonate other users or entities
- Attempt to gain unauthorized access to other accounts or system infrastructure
- Distribute malware, viruses, or other harmful software
- Interfere with or disrupt the platform's operation or infrastructure
- Scrape, crawl, or harvest data from the platform without authorization
5. User Content
You retain ownership of all content you create, post, or share on SupaWave ("User Content"). By posting User Content, you grant WavelyLabs a non-exclusive, worldwide, royalty-free license to display, distribute, and store your content solely for the purpose of operating and providing the SupaWave platform.
You represent that you have the right to share any content you post and that your content does not infringe upon the intellectual property rights of any third party.
6. Real-time Collaboration
SupaWave enables real-time collaborative editing where multiple participants can contribute to a wave simultaneously. You acknowledge that:
- Content within a wave may be edited by any participant with access
- You are responsible for content you contribute, even when collaboratively editing shared waves
- Changes made by participants are tracked and may be viewed through version history
- We are not responsible for content added or modifications made by other participants in your waves
7. Wave Sharing & Public Waves
Waves can be shared with specific participants or made visible to all users on the domain. When you add a participant to a wave, they gain access to view and edit the wave content. When you share a wave publicly (with the domain participant), all registered users on the server can view and participate in that wave.
You are responsible for managing access to your waves and should carefully consider who you invite as participants.
8. Attachments
SupaWave allows users to upload file attachments to waves, subject to the following:
- Individual file size limit: 10 MB
- Acceptable file types include common image formats (JPEG, PNG, GIF, WebP), documents (PDF, TXT), and other standard file types
- You must not upload files containing malware, viruses, or executable code designed to harm other users
- We reserve the right to remove attachments that violate these Terms or pose security risks
9. Intellectual Property
The SupaWave platform, including its design, logos, and proprietary features, is owned by WavelyLabs. SupaWave is built on the open-source Apache Wave protocol, which is licensed under the Apache License 2.0. Nothing in these Terms grants you rights to use the SupaWave or WavelyLabs trademarks without prior written permission.
10. Termination & Suspension
We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine is harmful to other users or the platform. Administrators may:
- Suspend accounts temporarily pending investigation
- Ban accounts permanently for serious or repeated violations
- Remove content that violates these Terms
You may delete your account at any time by contacting us. Upon termination, your right to access the platform ceases immediately.
11. Disclaimers & Limitation of Liability
SupaWave is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by law, WavelyLabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or profits, arising from your use of or inability to use the platform.
12. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and may notify you via email or a notice within the platform. Your continued use of SupaWave after changes are posted constitutes acceptance of the revised Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of SupaWave shall be resolved in accordance with applicable dispute resolution procedures.
